Products Liability

Products Liability

We live in a product-oriented society. In every aspect of life, from food and tools, to cars and car seats, products designed, developed, and manufactured by our clients play a major role.  Unfortunately, people sometimes get injured or property is damaged through product use. O’Meara Wagner, P.A.’s products liability attorneys have many years of experience  forming and maintaining relationships with product manufacturers, distributors, users and insurers. We provide reliable and cost-effective analyses and advice on product liability claims which our extensive experience shows leads to the best possible results for our clients.

Our experience in litigating products liability cases encompasses not only products that people use everyday, but also includes litigating cases involving alleged industrial and environmental contaminants. We have and continue to represent clients in toxic and mass tort litigation since the earliest days of asbestos lawsuits. We continue to represent a wide variety of clients in traditional mass exposure cases, but times have changed, and so have the claims in toxic tort and mass exposure cases. Exponential increases in the value of verdicts and awards, and the threat of even more insidious exposures, have significantly expanded toxic tort claims. Personal injury and property damage claims involving mold, food contamination, silica and other contaminants are proving to be equally as challenging as the more traditional cases. Our products liability attorneys focus on the key issues facing our clients in all toxic tort cases: the nature and characteristics of the contaminant of concern, the alleged exposure and dose-response relationship, and the viability of the claimant’s scientific and medical theories in light of the court’s expert admissibility standard. Our approach results in efficient and cost-effective case management for our clients.

O’Meara Wagner, P.A.’s clients include large and small companies, designers, manufacturers, and sellers of products and components used in commercial and residential construction, pharmaceuticals, cosmetic implants, and manufacturing equipment. We maintain and grow our client relationships through reliable and cost-effective counsel, both before and after the commencement of litigation. Our skilled and experienced attorneys are always well prepared to try cases when necessary; but also pride themselves in identifying and developing creative and favorable negotiation terms for those cases that are better settled. We also understand and are very sensitive to the other factors facing our clients when confronted with products liability claims, such as public relations, costs and exposures, and the essential business relationships between every entity in a product’s manufacturing and supply chain.  manufacturer/supplier/retailer relationships We assist our clients not only in post-damage products litigation, but also in product development and compliance with industry standards.
