O’Meara, Leer, Wagner & Kohl, P.A. Obtains Summary Judgment Dismissal of Alleged “Cow” Related Accident

In June of 2008, Plaintiff allegedly was involved in a motor vehicle accident with a cow in a rural area of Minnesota.  Plaintiff asserted claims of negligence and violations of Minn. Stat. § 346.16, including a claim for treble damages against Defendant.  O'Meara, Leer, Wagner and Kohl represented the Defendant landowner.

On September 21, 2012, Dakota County Judge Richard G. Spicer dismissed all of Plaintiff's claims at the summary judgment stage on the grounds that there was no evidence that Defendant was negligent or in violation of Minn. Stat. § 346.16.  As such, the case was dismissed with prejudice.
